Wrongful Death

According to Florida Statue 786.19, when a person’s death results from the wrongful act, negligence, default, or breach of contract of another person , the survivors or the estate of the deceased person may bring a civil lawsuit in Florida’s courts.

Only the personal representative named in the deceased’s will may bring the wrongful death lawsuit.
